Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, software, and services operated under the name Turninspect (the “Service”). The Service is provided by academi.cx Inc., a corporation incorporated under the Canada Business Corporations Act (corporation number 1777537-7), with its registered office at 200 Bay Street, North Tower, Suite 1200, Toronto, Ontario, M5J 2J2, Canada (“academi.cx”, “we”, “us”, or “our”).

By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction (typically 18, and 19 in some Canadian provinces), you may use the Service only with the consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Turninspect is an independent third-party tool that allows users to submit documents for analysis and to receive a generated report in PDF form. We are not affiliated with, endorsed by, or sponsored byTurnitin, LLC or any of its parent, subsidiary, or affiliated entities. “Turnitin” is a trademark of its respective owner and is used here for descriptive purposes only.

Reports generated through the Service are provided for your personal review and informational purposes only. They are not official academic-integrity findings, are not certified by any educational institution, and must not be represented as such.

To use most features of the Service you must create an account. You agree to provide accurate information, to keep your credentials secure, and to be responsible for all activity that occurs under your account. We use a third-party identity provider (currently Clerk) for account management; their terms and privacy policy also apply to your account data.

You may close your account at any time from the dashboard or by contacting us at hi@turninspect.com. We may suspend or terminate your account at our discretion if we believe you have violated these Terms, abused the Service, or attempted to interfere with its operation or security.

The Service operates on a pay-per-report basis. You purchase credits, and one credit is consumed each time a report is generated. Credits expire 24 hours after the time of purchase or grant; unused credits expire automatically and are not refundable. Credits have no cash value, cannot be transferred between accounts, and cannot be redeemed for cash.

Payments are processed by Stripe, Inc. (“Stripe”), our third-party payment provider. academi.cx Inc., doing business as Turninspect, is the seller of record for all purchases. By making a purchase you also agree to Stripe’s terms of service and privacy policy as they apply to your transaction. Applicable sales tax, GST/HST, or other location-based taxes will be added to your purchase price where required by law.

Refunds. All sales are final. Credits, whether used or unused, are non-refundable. The only exception is if the Service is unavailable due to a sustained outage caused by us, in which case we may, at our sole discretion, refund unused credits or issue replacement credits. To request consideration for an outage-based refund, contact hi@turninspect.com within 30 days of the affected purchase.

Nothing in this section limits any non-waivable refund right you may have under applicable consumer-protection law. For full details, see our Refund Policy.

We may change pricing at any time. Pricing changes apply to future purchases only and do not affect credits you have already bought.

You retain ownership of any document, file, or other material you upload to the Service (“Your Content”). By uploading Your Content, you grant Turninspect a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and submit Your Content to third-party services strictly for the purpose of providing the Service to you.

You represent and warrant that:

• You own Your Content or have all rights, licenses, consents, and permissions necessary to upload it and to permit its processing as described in these Terms.
• Your Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party, and does not violate any law or regulation.
• You will not upload content that is unlawful, defamatory, obscene, harassing, malicious, or that contains personally identifying information about third parties without their consent.

Documents you upload are processed through Turnitin’s systems. As a result, content may be added to that third party’s databases according to their policies, which we do not control. By uploading a document you acknowledge and accept this. If this is unacceptable for your situation, do not use the Service.

You agree not to use the Service to:

• Submit content you do not own or do not have permission to submit.
• Engage in academic dishonesty, fraud, misrepresentation, or any activity that violates the rules of an educational institution or applicable law.
• Resell, redistribute, white-label, or otherwise commercially exploit the Service or any output of the Service without our prior written consent.
• Reverse engineer, scrape, crawl, or otherwise attempt to extract data, source code, or systems from the Service except as permitted by law.
• Circumvent any rate limits, daily caps, or access controls, or attempt to gain unauthorized access to accounts, systems, or data.
• Upload viruses, malware, or any content designed to disrupt or damage the Service or any third party.

Reports generated by the Service reflect the output of third-party detection systems at the time of analysis. Detection algorithms change over time, can produce false positives and false negatives, and are not guaranteed to match the results of any future or institution-administered analysis. The Service is provided as an informational tool only. We make no representation that any report will accurately predict, replicate, or determine the outcome of any academic-integrity process.

You alone are responsible for any decisions you make based on a report. Turninspect is not responsible for, and disclaims all liability arising from, any academic, professional, or legal consequence of your use of the Service.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service depends on third-party providers (including but not limited to authentication, storage, database, and analysis providers) whose availability is outside our direct control. We may, at our discretion, modify, suspend, or discontinue any part of the Service at any time, with or without notice.

All rights in the Service, including its design, code, content (other than Your Content), trademarks, and logos, are owned by Turninspect or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. All other rights are reserved.

The service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted operation.

To the maximum extent permitted by law, in no event will Turninspect, its operators, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or academic standing, arising out of or related to your use of the service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

You agree to defend, indemnify, and hold harmless Turninspect, its operators, employees, and agents from and against any claim, demand, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of or related to (i) Your Content, (ii) your use of the Service, (iii) your violation of these Terms, or (iv) your violation of any law or any right of a third party.

You may stop using the Service and close your account at any time. We may terminate or suspend your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. On termination, Sections 5 through 12, 14, and 15 will survive.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in Toronto, Ontario, and you consent to personal jurisdiction in those courts.

Nothing in this section affects any non-waivable rights you may have under the consumer-protection laws of your jurisdiction, including the right to bring proceedings in your local courts where required by law.

We may update these Terms from time to time. If we make a material change, we will update the “Effective” date above and, where appropriate, notify you by email or via the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
